1. Acceptance of Terms

By accessing or using WineSaint (winesaint.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the site. WineSaint reserves the right to modify these terms at any time; continued use of the site following any changes constitutes acceptance of those changes.

2. Intellectual Property

All content on WineSaint, including (without limitation) wine reviews, tasting notes, scores, editorial articles, grape guides, region guides, producer profiles, educational materials, course content, quiz questions, glossary definitions, and all associated text, is the original creative work of WineSaint and its contributors. This content is protected by copyright law.

The WineSaint geographic dataset, including vineyard parcel boundaries, appellation boundaries, classification data, vineyard names, hierarchical region structures, and all associated metadata, constitutes a proprietary compilation and database. The selection, coordination, arrangement, and presentation of this geographic data represents substantial creative effort and original authorship. This dataset is protected under applicable copyright, compilation copyright, and database protection laws.

Wine tasting notes, scores, short summaries, and all review content published on WineSaint are original creative works. Each review reflects independent, original analysis and expression.

3. Prohibited Uses

You may not, without prior written permission from WineSaint:

• Use any automated system, including (without limitation) web scrapers, crawlers, bots, spiders, or AI-powered extraction tools, to access, collect, copy, or download content or data from the site.
• Bulk download, extract, or systematically retrieve map data, vineyard boundaries, wine reviews, or any structured dataset from the site, whether through automated or manual means.
• Reproduce, redistribute, sublicense, sell, or create derivative works from the geographic dataset, map data, or any compilation of content from the site.
• Mirror, clone, or replicate any substantial portion of the site's content, structure, or data on another website, application, or service.
• Use AI assistants, language models, or similar tools to systematically extract, summarize, or repackage content from the site for use in another product or service.
• Remove, alter, or obscure any copyright notices, attribution, or proprietary markings from the site or its content.
• Access the site in a manner that circumvents technical measures designed to control access to content or data, including rate limits, authentication requirements, or referrer restrictions.

4. Map Data and Geographic Database

The WineSaint geographic database contains thousands of proprietary vineyard parcel boundaries, appellation boundaries, lieu-dit boundaries, and associated classification data compiled and created through substantial original effort. This database may not be extracted, copied, downloaded, or reused in whole or in part without express written permission.

Viewing map data during normal use of the site does not grant you any license, right, or interest in the underlying geographic database or its contents. The display of geographic features on the map is provided solely for informational purposes in connection with your personal, non-commercial use of the site.

Any unauthorized extraction, reproduction, or redistribution of the geographic database will be pursued under all applicable intellectual property laws, including copyright law, database protection law, and the Computer Fraud and Abuse Act (or equivalent legislation in your jurisdiction).

5. Permitted Uses

You are welcome to:

• View and read all content on the site for personal, non-commercial purposes.
• Share direct links to any page on WineSaint.
• Quote brief excerpts of editorial content (reviews, articles, guides) with proper attribution to WineSaint and a link to the original page, for the purpose of commentary, criticism, or review.
• Use the site's educational content for your own personal learning and professional development.

6. User Accounts and Education Platform

Certain features of WineSaint, including the Wine Saint Certified education platform, may require or benefit from user accounts. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Course content, quiz questions, exam materials, and certificates issued through Wine Saint Certified are proprietary. Sharing exam questions, reproducing course materials, or distributing certificates not earned through legitimate completion of the program is prohibited.

7. Third-Party Content and Attribution

The site incorporates map tiles from third-party providers, including OpenStreetMap (licensed under the Open Database License) and CARTO. These components are subject to their respective licenses and terms. All required attributions are displayed within the map interface.

8. Disclaimer of Warranties

WineSaint is provided "as is" and "as available" without warranties of any kind, whether express or implied. Wine reviews, scores, and tasting notes reflect the subjective opinions of the reviewer at the time of tasting and should not be relied upon as the sole basis for purchasing decisions. Geographic data is provided for informational purposes and may not reflect the most current official boundaries or classifications.

9. Limitation of Liability

To the fullest extent permitted by applicable law, WineSaint and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues (whether incurred directly or indirectly), arising out of your use of or inability to use the site, even if WineSaint has been advised of the possibility of such damages.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of the site shall be resolved in the courts of competent jurisdiction.
